PLEASE READ THESE TERMS OF USE CAREFULLY. THEY CONTAIN IMPORTANT INFORMATION ABOUT HOW YOU MAY USE THIS WEBSITE AND MOBILE APP, AS WELL AS YOUR LEGAL RIGHTS AND OBLIGATIONS. BY USING OUR WEBSITE OR MOBILE APP (THE “PROPERTIES”), YOU AGREE TO BE BOUND BY THESE TERMS OF USE. IF YOU DO NOT AGREE, DO NOT USE THE PROPERTIES.
GENERAL
The Properties are owned and operated by Indigo Books & Music Inc. (“Indigo”, “we”, “our”, “us”). “You” means the visitor or user of our Properties. “Properties” means any website or mobile app owned by or operated for Indigo that displays these Terms of Use.
These Terms of Use include both our terms for using the Properties and our terms of sale for purchases made through them. Each time you visit, interact with, or make a purchase on our Properties, you confirm your agreement to these Terms of Use.
We may update these Terms of Use at any time. When we do, we will update the date above. Your continued use of the Properties means you accept any updated version.
Indigo operates the Properties from Ontario, Canada. The United Nations Convention on Contracts for the International Sale of Goods does not apply. Except for residents of Quebec, Ontario law and the federal laws of Canada apply, and you agree to the exclusive jurisdiction of Ontario courts. If you reside in Quebec, Quebec law and the federal laws of Canada apply, and you agree to the exclusive jurisdiction of Quebec courts.
AGE OF MAJORITY REQUIRED
By using the Properties, you confirm that you are the age of majority in your province or territory (usually 18 or 19). If you are under the age of majority, you may only use the Properties if you are at least 14 and supervised by a parent or legal guardian who agrees to these Terms of Use. Parents or guardians are responsible for the minor’s use of the Properties, including any charges and legal liability incurred.
ACCOUNT REQUIREMENTS / EMAIL VERIFICATION
Certain features, such as checkout, account management, wishlist, the plum loyalty program, and ratings & reviews, require you to sign in and create an account using a valid email address.
You are responsible for everything that happens under your account, keeping your devices secure, and maintaining control of the email address linked to your account. Indigo is not obligated to verify the identity of anyone using your email address and is not responsible for unauthorized use of your account. Notify us promptly if your account or email address has been, or if you suspect it may have been, compromised. In such an event, we have the right to take any actions regarding your account or purchases that we deem reasonable, provided that we will have no liability for any acts or omissions in this regard.
By creating an account, you agree to:
- Provide true, accurate, and complete information.
- Update your information as needed.
- Not share access to your account or transfer ownership.
We may email you about important changes to these Terms of Use, your account, transactions, or membership(s).
PERSONALIZATION OF SERVICES
You can manage your personal information and email preferences at any time by signing into your account. We may use your purchase history, preferences, and interactions to personalize your experience, including tailoring content and sending product recommendations and offers.
You can manage or turn off personalization settings through your account and our Privacy Preferences page.
If you link your plum loyalty membership to your account, you give us permission to access related membership data, including historical purchases activity and points balance.
TRADEMARKS, COPYRIGHTS & INTELLECTUAL PROPERTY
All Indigo-related names, logos, domain names, and trademarks (the “Indigo Marks”) are owned by Indigo. Other trademarks belong to their respective owners. Nothing on the Properties grants you permission to use any trademarks without written consent.
All materials on the Properties and their compilation, arrangement and layout (the “Content”), including images, text, illustrations, music clips, videos,
downloads, and other materials, are protected by intellectual property laws, and Indigo and its partners expressly reserve all rights. You may view and
print Content for personal, non‑commercial use as long as you keep all copyright notices intact. Any other use, such as copying, distributing, scraping, mining, or modifying Content, requires Indigo’s prior written consent.

LIFESTYLE CONTENT
We may provide educational, entertainment, general lifestyle or product-or service-related information. This information is for guidance only. Always read product labels and consult professionals as needed, especially when making health, wellness, diet, or parenting decisions.
LINKS TO OTHER WEBSITES AND SERVICES
The Properties may link to third-party websites (“Linked Sites”). These are provided for convenience only and are not controlled or endorsed by Indigo. You access Linked Sites at your own risk, and any transactions you enter into with those sites are solely between you and them.
SOCIAL MEDIA & THIRD-PARTY SITES
You may also interact with us on third‑party platforms where Indigo posts content or invites feedback, such as Facebook, Instagram, Pinterest, TikTok and YouTube (“Third Party Sites”). While our Terms of Use and Acceptable Use Policy provide guidelines for interacting with Indigo, these terms do not apply to platforms Indigo does not own or control. Always review the terms of use of any Third Party Site you visit.
LIMITS OF LIABILITY & INDEMNIFICATION
The Properties and Content are provided “as is.” Your use is at your own risk. Indigo does not guarantee that product descriptions or Content are accurate or error‑free. To the extent permitted by law, Indigo disclaims all warranties or conditions, express or implied, including merchantability and fitness for a particular purpose.
Indigo and its directors, employees, and representatives are not liable for damages related to your use of the Properties, Linked Sites, or Third Party Sites, including direct, indirect, or consequential damages.
Some jurisdictions (including Ontario and Quebec) do not allow certain limitations, including the disclaimer of certain warranties or the limitations of certain liabilities, so these exclusions may not apply to you.
ONLINE SHOPPING TERMS AND CONDITIONS (“Terms of Sale”)
By placing an order through the Properties, you agree to these Terms of Sale. If you do not agree, do not proceed with your order.
(a) Ordering
Products and promotions on the Properties are invitations to purchase, not offers to sell. After you place an order, you will receive a confirmation that we received your order. This confirmation of receipt is not acceptance. Acceptance occurs only when Indigo sends a separate email or text message indicating that your order has been accepted. Your method of payment is charged upon acceptance.
Indigo may accept or reject all or a portion of any order. Orders may be cancelled due to pricing or description errors, availability issues, fraud concerns, recalls, or other reasons. For rejected orders, Indigo will have no obligation to fulfill your order and you will have no obligation to pay.
(b) Pre‑Orders
We often provide the opportunity to pre-order products or services on the Properties before the products or services are available for sale. Pre‑order
payment is charged when the order is placed. Release dates and quantities are determined by suppliers and may change. We do not guarantee that all pre‑orders can be fulfilled and refunds will be issued where necessary.
(c) Availability and Quantity Limits
Despite Indigo’s efforts to be in stock, products and services are subject to availability. When we communicate that an item or service is unavailable, Indigo has no obligation to fulfill the order, and you have no obligation to pay. To assist with availability, Indigo may limit purchase quantities and may decline orders believed to be for resale.
(d) Prices
All prices are in Canadian dollars and exclude taxes. Online pricing may differ from in‑store pricing and is not eligible for price matching. Special online pricing and promotions that are not available in-store, are identified as “Online” or “Online Only” offers. Prices may change while items remain in your cart. The quoted order total includes any applicable shipping & handling fees, any environmental or other additional fees, and an estimate of all applicable taxes. By completing checkout, you agree to pay the displayed total, which will be charged to your selected payment method upon Indigo’s acceptance
of the order.
(e) Pricing or Description Errors
We strive to ensure the accuracy of our pricing and product and service descriptions; however, errors may still occur. Product and service descriptions, representations, warranties, and performance claims are provided by our suppliers and are not independently verified by Indigo. Indigo may cancel orders affected by pricing or description errors. You will be notified and refunded where applicable. If you find that a product you purchased is not as described, your sole remedy is to return it in accordance with our Return Policy.
(f) Payment Methods
We accept payment via VISA (Debit & Credit), Mastercard (Debit & Credit), American Express, Diners Club, Discover, Google Pay, Apple Pay, PayPal and valid Indigo gift cards and plum points.
(g) Delivery
Orders ship only within Canada (except digital gift cards). Delivery delays may occur and Indigo will inform you as soon as possible. Indigo is not responsible
for delays outside its control. Shipping fees apply per package shipped. Visit Shipping & Returns for additional information
(h) Express Pick Up / Ship to Store
Where available, you may order online and pick up in‑stock items in‑store (Express Pick Up) or order online and ship items to a store for pickup (Ship to Store). Express Pick Up is only available at locations that already have inventory of the product(s) and requires a minimum of three-hours advance notice for the store to pick and pack your order. Email notifications will be sent when Express Pick Up or Ship to Store orders are ready for pick up.
(i) Cancellations, Returns & Refunds
Returns by mail are subject to a return delivery fee, while orders returned in-store are free. Shipping and handling charges are non‑refundable. Returns are governed by Indigo’s Return Policy and applicable consumer protection laws.
(j) Store Pricing and Availability
Online listings of in‑store items are for convenience only. Availability and pricing may differ in stores. Contact your local store to confirm details.
(k) Communications About Your Order
We may contact you about your order using your preferred communication method. Carrier fees may apply to mobile communications.
ACCEPTABLE USE TERMS
These terms govern all permitted use of the Properties, Linked Sites, and Third Party Sites.
(a) Your Representations
You confirm that any content you submit:
- is your own and does not infringe others’ rights
- is accurate, lawful, and not misleading or offensive
- does not contain personal information of others
- does not contain spam, ads, or outside links
- reflects your genuine experience (for ratings/reviews)
- may be publicly posted, including any personal information you include
(b) Online Conduct
You may not engage in conduct that limits or interferes with others’ use of the
Properties. You may use the Properties only for lawful purposes.
(c) Ownership of Submitted Content
By submitting content, you grant Indigo a perpetual, irrevocable, royalty‑free right to use, copy, display, modify, translate, publish, reproduce, and distribute
the content in any medium.
PRIVACY
Please review our Privacy Policy to learn how we collect, use, and disclose your personal information.
DENIAL OF ACCESS; MODIFICATION/SUSPENSION
Indigo may limit, suspend or terminate your account or access to the Properties at any time if you violate these Terms of Use or pose a security risk. Indigo may also modify or discontinue any part of the Properties without notice.
SEVERABILITY & ASSIGNMENT
If any part of these Terms of Use is invalid or unenforceable, all remaining parts continue to apply. Indigo may assign its rights or obligations under these Terms at any time.
ENTIRE AGREEMENT
These Terms of Use, together with any incorporated terms, form the entire agreement between you and Indigo regarding use of the Properties and supersede any prior agreements.
